While the final draft of the rule has not been released by MDH (anticipated in late December 2010), these are the changes you are most likely to see starting August of 2011:
- Every sheet of ice will require a certificate that will be renewed annually this would be for ice arenas using either electric or non-electric ice resurfacing equipment. Currently MDH does not have the authority to charge a fee for certification, to do this they would need legislative authority (a law allowing them to do so) if enforcement of the rule becomes too costly they may have to ask for this.
- Levels of acceptable and actionable carbon monoxide (CO) and nitrogen dioxide (NO2) will be lowered, and there will be more prescriptive measures listed for owners and operators to follow should an incident occur.
- More frequent testing will be required, how much more often is still being debated.
- Ice Edgers will be included in the rule along with prescriptive measures for air quality testing.
- Provisions will address the use of modern air monitoring equipment including constant monitors, with the burden of proof of accuracy being on the owner/operator of the ice arena.
- Use of other CO and NO2 producing equipment will be addressed such as leaf blowers, portable heaters, man lifts, and forklifts will be addressed.
- Training will be a major aspect of the rule, the rule will proscribe who needs to be trained, when and how trained individuals will be available at the ice arena.
